Who is behind digency.es, on what terms you may use the website and what responsibility we take on.

2. What this website is and who it is for

digency.es is the website of Digency, a digital marketing agency with an office in Sabadell. It exists to explain what we do, show our work, publish articles on the blog and start a conversation: through the contact form, the quote form, the artificial intelligence assistant or the WhatsApp button.

It is aimed at companies and professionals. Access is free and open and requires no registration. Hiring a service is always done separately and in writing: nothing on the website is, in itself, a contractual offer.

This legal notice governs the use of the website. By browsing it you accept the notice; if you do not agree with any of its terms, please do not use the site.

3. Terms of use

You undertake to use the website lawfully and in line with this notice. In particular, the following is not allowed:

  • Entering false data in the forms or the assistant, or other people's data without their authorisation.
  • Attempting to access the admin panel, the API or any non-public part of the website, or circumventing its security measures.
  • Using the assistant for purposes other than finding out about our services, trying to manipulate its answers or extracting its content in bulk.
  • Introducing malicious code, overloading the server, crawling the website automatically for commercial purposes or interfering with how it works.
  • Reproducing or exploiting the content for commercial purposes without our permission.

If we detect use that goes against these rules, we may limit or block access, without prejudice to any legal action that may apply. You are liable for any damage caused by improper use.

4. Forms, quotes and the AI assistant

Forms. The data you send through the contact form or the quote form must be truthful and up to date. How we handle it is explained in the privacy policy.

Indicative quote. The range worked out by the quote page comes from reference rates and the items you tick. It is an estimate to give you an idea, not a binding offer: the final price is agreed afterwards, in writing, once we know the real scope of the project.

AI assistant. The website includes an assistant that answers using a language model from the provider Anthropic. Its answers are generated automatically from the information on the website and may contain errors or inaccuracies, or may be out of date. They are there to give you an idea; they are not professional advice, nor an offer, nor a contractual commitment. What counts is what someone from the team confirms to you. Do not write health data, beliefs or other special categories of data in the chat, nor data about third parties.

5. Intellectual and industrial property

The design of the website, its code, the texts, the photographs, the videos, the Digency logo and every other element belong to DIGENCY SL or to third parties who have authorised their use, and are protected by intellectual and industrial property law.

You may view, download and print the content for personal use or to assess our services. You may not reproduce, distribute, alter or publicly communicate it for commercial purposes without our written authorisation. Blog articles may be quoted in part with a link to the source.

Client logos and brands appear with their authorisation, as evidence of the work carried out, and belong to their owners. The same applies to any third-party brands mentioned (WhatsApp, Google, Instagram, LinkedIn): they are cited for identification purposes only.

6. External links and WhatsApp

The website links to third-party sites: our profiles on Instagram and LinkedIn, the client websites mentioned in the projects and, from the floating button, the WhatsApp app or website (Meta). We do not control those sites and we are not responsible for their content, their availability or how they handle your data: once you leave digency.es, their terms apply.

The WhatsApp button is a link, nothing more: it installs nothing on your device and loads no Meta scripts on our website. The conversation takes place in WhatsApp, under its terms and its privacy policy.

You may link to any page of digency.es as long as the link leads to the page as it is, without frames, without suggesting a relationship that does not exist and without presenting our content as your own.

7. Liability and availability

We look after the website carefully, but we cannot guarantee that it will be available at all times or free of errors. We may interrupt access temporarily for maintenance, improvements or incidents, and we may change the content without prior notice.

We are not liable for damage arising from improper use of the website; from faults in your connection, browser or device; from viruses or other harmful elements introduced by third parties despite our measures; or from decisions taken on the basis of information on the website, including the assistant's answers, without checking them with us first.

None of the above limits liability that the law does not allow to be excluded.

8. Data protection and cookies

How we handle the personal data we collect through the forms, the assistant, WhatsApp and your browsing is set out in the privacy policy. Which cookies the website uses, what for and how to change your choice is in the cookie policy. Both form part of this legal notice.

9. Applicable law and jurisdiction

This legal notice is governed by Spanish law. To settle any dispute arising from use of the website, the parties submit to the courts and tribunals of Sabadell, unless a mandatory rule establishes another venue: if you are acting as a consumer, the courts of your place of residence.

10. Changes to this notice

We may update this notice when the website, the services or the applicable rules change. The version in force is always the one published on this page, with its update date at the top. It is worth rereading it now and then.
